1. Acceptance of Terms

These Terms and Conditions ("Terms") govern your access to and use of financedomainselite.com (the "Site") operated by Finance Domains Elite LLC ("Finance Domains Elite," "we," "us," "our"). By accessing the Site, submitting any form, or subscribing to our communications, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Site.

2. Description of Services

Finance Domains Elite provides independent, fee-only financial planning and investment advisory services to residents of the United States under one or more written advisory agreements. Nothing on this Site constitutes an offer to provide services in any jurisdiction where we are not registered or exempt from registration. Website content is provided for general informational and educational purposes only.

3. No Investment Advice; Risk Disclosure

• All investing involves risk, including the possible loss of the entire principal amount invested.
• Diversification and asset allocation do not guarantee profit or protect against loss in declining markets.
• Projections (such as those in our Projection Studio) are hypothetical, assume a fixed rate of return, and do not reflect actual client results; actual returns will vary and may be negative.
• Past performance is not indicative of future results.

4. Eligibility

You must be at least 18 years old and a resident of the United States to submit enquiries or enter into an advisory relationship through the Site. By using the Site, you represent that you meet these requirements.

5. Your Obligations

• Provide accurate, current, and complete information in all forms and communications;
• Maintain the confidentiality of any client-portal credentials issued to you;
• Use the Site only for lawful purposes and not attempt to disrupt, scrape, or gain unauthorized access to it;
• Notify us promptly of any unauthorized use of your accounts or information.

6. Fees & Billing

Published plans (e.g., Foundation $290/month; Signature $690/month; Private Client from 0.85% of assets under management annually) are indicative and governed by your signed advisory agreement and our Form ADV, which control in the event of any conflict. Flat-plan fees are billed monthly in advance; AUM fees are billed quarterly in arrears based on average daily balances. You may cancel non-registered-plan services with 30 days' written notice; the final invoice is prorated. The initial 45-minute consultation is free of charge.

7. Custody of Assets

Client assets are held at independent, SIPC-member qualified custodians. Finance Domains Elite is granted limited trading authority only and never takes possession of client funds or securities. Custodians, not Finance Domains Elite, hold and safeguard client assets, and their statements are the authoritative record — we encourage you to compare them with ours.

8. Intellectual Property

All Site content — text, graphics, logos, the Finance Domains Elite name and marks, charts, calculators, and page design — is the property of Finance Domains Elite LLC or its licensors and is protected by U.S. copyright and trademark law. You may view, download, and print content for personal, non-commercial use only. Any other reproduction, distribution, or derivative use requires our prior written consent.

9. Communications Consent

By submitting a form, you consent to receive email, phone, and — where you provide a mobile number and opt in — text communications from us regarding your enquiry or services, including through automated means where permitted by law. Message and data rates may apply. You may withdraw marketing consent at any time via unsubscribe or by contacting us; essential account and regulatory notices will continue.

10. Limitation of Liability

To the maximum extent permitted by law: (a) the Site is provided "as is" and "as available" without warranties of any kind, express or implied; and (b) Finance Domains Elite, its members, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from or related to your use of the Site — even if advised of the possibility. Where liability cannot be excluded, our aggregate liability arising from the Site shall not exceed $100. Nothing in this section limits liability that cannot be limited by law, nor obligations arising under a signed advisory agreement.

11. Indemnification

You agree to indemnify, defend, and hold harmless Finance Domains Elite LLC and its personnel from and against any third-party claims, damages, losses, and reasonable expenses (including attorneys' fees) arising from (a) your breach of these Terms, (b) information you submit that is false or infringing, or (c) your misuse of the Site.

12. Term & Termination

These Terms take effect when you first use the Site and continue until terminated. We may suspend or terminate your access at any time, with or without cause, including for suspected fraud or abuse. Provisions that by their nature should survive termination (including Sections 3, 8, 10, 11, and 13) shall survive.

13. Dispute Resolution; Arbitration

Any dispute arising out of or relating to the Site or these Terms shall first be addressed by good-faith negotiation for 30 days. If unresolved, the dispute shall be settled by binding arbitration administered under the Commercial Arbitration Rules of the American Arbitration Association, seated in Atlantic County, New Jersey, before a single arbitrator. You and Finance Domains Elite each waive the right to a jury trial and to participate in a class action. Nothing herein limits your right to bring a claim before the SEC or applicable state regulators, or to seek individualized regulatory relief.

14. Governing Law

These Terms are governed by the laws of the State of New Jersey, USA, without regard to conflict-of-law principles.

15. Severability & Entire Agreement

If any provision of these Terms is found unenforceable, it will be modified to the minimum extent necessary and the remainder will stay in force. These Terms, together with the Privacy Policy and any advisory agreement you sign, constitute the entire agreement between you and Finance Domains Elite regarding the Site.

16. Changes to These Terms

We may revise these Terms from time to time. The revised version will be posted on this page with an updated date; continued use of the Site after posting constitutes acceptance.
